Article 1 (Purpose)
These Terms govern the rights, obligations, and responsibilities between the Company and users in connection with the use of the fple.live service (the "Service") operated by 주식회사 퍼스트플레이트 (the "Company").
Article 2 (Definitions)
- "Service" means the mail-order brokerage platform and related supplementary services provided by the Company.
- "User" means a member or non-member who accesses the Service and uses it in accordance with these Terms.
- "Seller" means a business operator who has been approved through onboarding review for the purpose of selling its own products through the Service.
- "Member" means a person who has signed up for the Service through Kakao OAuth authentication and may use it on an ongoing basis.
Article 3 (Status of the Mail-Order Broker)
The Company is a mail-order broker for mail-order transactions between sellers and users, and is not a party to the mail-order transactions for the products and trades registered by sellers. The obligations and responsibilities related to transactions—such as product information registered by each seller, order processing, delivery, exchange, return, and refund—rest with the relevant seller, and the Company is not liable for them.
However, the Company bears responsibility, in accordance with applicable laws and these Terms, for damages caused by defects in the services the Company provides directly (platform operation, payment-agency integration, customer-service brokerage, etc.).
Article 4 (Effect and Amendment of the Terms)
- These Terms take effect by being posted on the Service screen or otherwise announced to users.
- The Company may amend these Terms within the scope that does not violate applicable laws, and will announce any amendment from 7 days before its effective date (30 days before in the case of changes unfavorable to users).
- If a user does not agree to the amended Terms, the user may stop using the Service and request membership withdrawal.
Article 5 (Sign-up and Information Collected)
- Sign-up is established when a user agrees to these Terms and the Privacy Policy through Kakao OAuth authentication and provides the required personal information.
- The required item provided by the provider at sign-up is the Kakao account identifier. The name, phone number, and default delivery information may be provided as Kakao consent items or entered directly by the user at the time of sign-up or ordering.
- Optional items (gender, age range, birthday, year of birth, profile image) may be declined; if declined, some personalization features that use those items (tailored product recommendations, birthday benefits, etc.) will be limited.
- Members use the Kakao OAuth identifier as their account identifier. Email is not collected as a sign-up field entered directly by the user; where necessary, the value returned in the Kakao OAuth response may be stored in the internal profile.
- The Company may refuse sign-up if the applicant has entered false information or is likely to significantly impair the operation of the Service.
Article 6 (Obligations of Members)
Members must not engage in any of the following acts.
- Stealing another person's information or registering false information
- Interfering with the operation of the Service or intentionally causing system failures
- Using the Service to commit acts that violate laws or public order and morals, or that infringe the rights of others
- Reproducing, distributing, or commercially using information obtained within the Service without authorization
Article 7 (Provision and Modification of the Service)
- As a rule, the Service is provided 24 hours a day, year-round. However, it may be temporarily suspended for unavoidable reasons such as system maintenance, failures, or natural disasters.
- The Company may change the content and composition of the Service, in which case it will announce the changes and the effective date in advance.
Article 8 (Payment and Refunds)
- Users pay for products through the payment methods designated by the seller (credit card, bank transfer). Card payments are made through the payment window of an external payment gateway (PG).
- After payment is completed, refunds, exchanges, returns, etc. are processed according to the policies set by the seller and applicable laws (Act on Consumer Protection in Electronic Commerce, Framework Act on Consumers, etc.).
- The Company may attempt mediation, such as by providing both parties with information necessary to resolve a dispute between seller and buyer, but bears no direct obligation to resolve it.
Article 9 (Limitation of Liability)
- The Company is exempt from liability when it cannot provide the Service due to force majeure such as natural disasters, war, or suspension of service by a telecommunications carrier.
- The Company is not liable for disruptions to the use of the Service caused by reasons attributable to the user.
- The Company is not liable for transactions made between sellers and users, in accordance with Article 3.
Article 10 (Dispute Resolution)
If a dispute arises between the Company and a user in connection with the use of the Service, both parties shall consult in good faith to resolve it; if no agreement is reached, a suit may be filed with the competent court. The competent court for litigation related to these Terms shall follow the procedures set by the Civil Procedure Act.
Addendum
These Terms take effect from 2026-04-23.
